An Analysis of the Code of Conduct of Lawyers in Nepal

Abstract

The Code of Conduct (hereinafter referred as COC) is the body of legal and ethical rules that intends to regulate the conduct of lawyers. Transparency, secrecy, honor, adherence, politeness, and dedication are the common principles of COC of lawyers. The obedience of COC results in the development of a vibrant bar being able to place the bench on track with the outcome of rule of law. COC was begun with the introduction of the legal profession simultaneously. In this background, this article examines the appropriateness of the existing COC of Nepalese lawyers prevalent for the last 27 years without any substantial changes from a different perspective and recommends for its modification in view of the changes in the governing system, science and technology and social reality at the par of time. It focuses on the need for continuity of autonomy of the legal profession in the reform efforts and disagrees with the proposal that the Disciplinary Committee of the Nepal Bar Council shall be chaired by the Justice.
